Union Home Minster Amit Shah on 7 August is set to move the Government of National Capital Territory of Delhi (Amendment) Bill, 2023 in Rajya Sabha. This comes after the the bill was passed in the lower house i.e. in Lok Sabha on 3 August by voice vote. The ordinance on the control of services in Delhi was promulgated in May days after the Supreme Court verdict on the issue.

Currently in Rajya Sabha, there are a total of 245 seats of which eight are vacant and makes the total number of seats to 237. The majority mark to pass the Bill in Rajya Sabha will be 119. On the other hand, with the combined numbers of all parties who have extended support to AAP, including the Congress, is 105.

The Government of National Capital Territory of Delhi (Amendment) Bill, 2023, seeks to replace the ordinance brought by the Centre in May which excluded ‘services’ from the legislative competence of the Delhi legislative assembly. The Delhi ordinance was promulgated by the central government a week after the Supreme Court handed over the control of services in Delhi excluding police, public order and land to the elected government, headed by CM Arvind Kejriwal.

The Government of National Capital Territory of Delhi (Amendment) Bill, 2023 was passed in the Rajya Sabha with 131 votes. The Opposition MPs fell short and only totaled 102 votes. The bill has been a point of contention between the Aam Aadmi Party, which governs Delhi, and the central government. It was already passed in the Lok Sabha on August 3. 

It will replace the existing central government’s ordinance on the transfer and posting of officers. The ordinance was brought in just days after the Supreme Court gave executive powers to the Delhi government in service matters.

The Government of National Capital Territory of Delhi (Amendment) Bill, 2023, which deals with transfers and postings of senior officers in the Delhi government, was passed by the Rajya Sabha on Monday with 131 votes amid support from fence-sitter parties like BJD and YSR Congress Party. The legislation was passed by the Lok Sabha on August 3 and now awaits approval from the President to become law.

The bill was tabled by Union Home Minister Amit Shah in the Upper House to replace an ordinance that was promulgated by the Centre on May 19. It was passed with 131 votes in favour and 102 votes against the motion.

The Centre brought the ordinance a week after the Supreme Court handed over the control of services in Delhi, excluding police, public order and land, to the elected government.

Amit Shah said the aim of the bill was to make sure there was a “corruption-free administration in Delhi” and it doesn’t violate the Supreme Court order.
